Periodically, the Board of Directors believes that it is helpful to the Membership to remind Owners of their continuing responsibilities when they rent their homes. The Rules established by the Association to guide the legal owners and tenants are set forth in detail in Article VI of Chapter 1, Sections 1-91 to 1-94 of the Administration Rules.
Those responsibilities include the duty to promptly register those tenants with the Association, and, if desired, to assign their rights to use the recreational facilities in our Community to those tenants.
However, that does not end the Owner’s responsibilities. Owners must try to ensure that their Tenants continue to follow WVA Rules & Regulations and do not create nuisances on their Lot or elsewhere in the Community. It is important to note, the Owner/Landlord remains responsible to the Association for any fines and disciplinary actions that may be taken as a result of the Tenant’s activities. Complaints leading to nuisance claims frequently concern noise and aesthetics.

Additionally, there are City restrictions on boarding houses, but the Association has more restrictive rules regarding the number and relationships of tenants under the single family rule, as permitted by the Courts.
The Owner/Landlord should provide the Tenant with a copy of the Association’s Rules and Regulations, and emphasize that the neighbors are entitled to the quiet enjoyment of their homes as well. Finally, a responsible Owner/Landlord will monitor the condition of their home and its maintenance as well as the conduct of their Tenants.
